This End-User License Agreement ("Agreement") is a legal agreement between you and Maritime Master Limited ("we", "us"), a company registered in England and Wales (company number 15339200), governing your use of the Kaleidoscope Plan applications and related services (the "App"). By downloading or using the App, you agree to these terms. If you do not agree, do not use the App.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and applicable usage rules.
2. Restrictions
You agree not to:
- copy, redistribute, sublicense, rent, lease or sell the App;
- reverse engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits;
- remove or alter any proprietary notices; or
- use the App in any unlawful manner or in breach of this Agreement.
3. Ownership
The App is licensed, not sold. We and our licensors retain all right, title and interest in and to the App, including all intellectual property rights. The content you create with the App remains yours.
4. Your content
You are responsible for the drawings, scans, photos and other content you create and export. Because that content is stored on your device, you are responsible for backing it up. See our Privacy Policy for how data is handled.
5. Updates
We may provide updates, which may add, modify or remove features. This Agreement governs any updates unless they are accompanied by separate terms.
6. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. Outputs such as coverage estimates, heat-maps, area figures and compliance guidance are provided for planning purposes only and must be independently verified by a qualified professional before they are relied upon.
7. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or relating to your use of the App. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Termination
This Agreement is effective until terminated. Your rights under it terminate automatically if you breach it. Upon termination you must stop using the App and delete all copies.
9. Apple App Store
The following applies where you obtain the App from the Apple App Store:
- This Agreement is between you and us only, not with Apple.
- Apple has no obligation to provide maintenance or support for the App.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims relating to the App are between you and us.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
Alternatively, you may choose to rely on Apple's standard Licensed Application End User License Agreement; if you do, link to it here instead of this section.
10. Governing law
This Agreement is governed by the laws of England and Wales, without regard to its conflict-of-laws rules, and the courts of England and Wales will have exclusive jurisdiction, except where applicable consumer law provides otherwise.
